Q.
In what language are court and arbitration proceedings conducted in Thailand?
A. Court proceedings
in Thailand are conducted in Thai. All documents which are introduced as evidence
must be in Thai or translated into Thai. Witnesses may testify in a foreign language,
but their testimony must be translated into Thai. For arbitration, proceedings
can be conducted and documents submitted in the language agreed upon by the parties.
Q.
Can affidavits be used instead of witness testimony?
A.
Affidavits are generally not accepted as evidence in Thai
courts. However, they may be used in the IP&IT and Tax Courts if the affiant can
be cross-examined in court.
