      Primary Functions:
      • Supervise and instruct staff of attorneys and investigators in contentious matters, litigation and enforcement of rights involving copyrighted materials, trademarks, trade secrets and patents. Train police, customs officials, excise and other law enforcement officials in anti-counterfeiting and anti-piracy tactics. Develop, coordinate, implement and manage turnkey anti-counterfeiting and anti-piracy campaigns, including investigation and forensic analysis of technical evidence (and financial evidence, i.e., the "money trail"), police raids on manufacturers, wholesalers, distributors, importer/exporters and retailers of counterfeit goods. Later migrated the practice from serving Thailand alone to a broader geographic area covering former Indochina (Laos, Cambodia, Vietnam and Myanmar).
      • Develop a world-renowned specialization in profiling, tracking and identifying traffickers associated with, and assets of, organized criminal syndicates and trafficking of illicit goods into or through Thailand. Recruit, equip, train and lead a High Tech Team with an international reputation as a leader in the provision of Strategic and Tactical Internet-based Open Source Intelligence (OSINT) support and training services to police, intelligence, regulatory and other law enforcement related agencies in SE Asia.
      • Collaboration with and training of Royal Thai Customs in border control. Collaboration, training and supervision of Public Prosecutors in criminal prosecutions, management of civil lawsuits, appeals, media campaigns, and public education efforts.
      • Crisis response management in defense of cases involving threatened infringement.
      • Deliver an integrated approach to strategy consulting, research, public relations, and political relations. Preparation of authoritative white papers, news articles, and targeted press interviews to effectively communicate message and strategy. Implementation, execution and reinforcement of messaging.
      • Lobby for practical legislative reforms of legislation and regulation. Counsel private sector clients and consult with foreign trade delegations and Thai negotiators in respect of sensitive issues in the US-Thailand and Japan-Thailand Free Trade Agreement negotiations.

Tried in excess of thirty cases to jury verdict.
  • Ed is a social activist, and he and his wife, Sasithorn, manage micro-finance projects to incubate sustainable economic development at the village level in Thailand and Cambodia. Ed is on the Advisory Board and actively participates in the activities of an NGO called SISHA in Cambodia, where the mission includes rescues of victims of child and human trafficking, the profiling, tracking, arrest and extradition of paedophiles to be prosecuted in western jurisdictions and the medical treatment of, vocational training of, and sustainable employment of victims of trafficking. In their spare time, Ed and Sasithorn maintain a working rice farm in rural Burirum Thailand. Ed also enjoys sailing and trains in Muay Thai Boxing and in Aikido.

Recent Achievements:

  • Delivered the Keynote Address "Blood Money: The Steep Human Cost of the Counterfeit Culture", at the International Anti-Counterfeiting Coalition's (“IACC”) Annual Fall Conference, Dallas, Texas, October 4-6, 2006.
  • Lead counsel in defense of Carlsberg A/S in UNCITRAL International Commercial Arbitration involving a US$500 million claim for alleged wrongful termination of license agreements.
  • Lead external counsel for PReMA, the Pharmaceutical Research and Manufacturing Association in Thailand, advising PReMA on pharmaceutical and US-Thailand Free Trade Agreement legal issues, including patent, compulsory license, data exclusivity and market access issues. The Association of 43 member companies was founded as a non-profit, non-government organization to represent Thailand’s pharmaceutical manufacturers and associated companies.
  • Lead counsel for Yamaha Motor Corporation in enforcement of industrial design rights and invention patents in a criminal prosecution of a BOI promoted manufacturer of infringing motorcycles. Police raids in March 2006 resulted in seizures of more than 1081 fully assembled motorcycles valued at more than US$1 million.
  • Lead counsel for DaimlerChrysler Mercedes Benz in enforcement of trademarks in a criminal prosecution of a manufacturer of counterfeit automobile parts. Police raids in October 2005 resulted in seizures of manufacturing equipment, and more than 50,000 fake parts and accessories valued by law enforcement officials at more than US$25 million
  • Lead counsel for Pfizer, AstraZeneca, Novartis, Bristol Myers Squibb, GSK, sanofi-aventis, Abbott Laboratories and Merck & Co., among others, in planning and execution of a defensive strategy to respond to the Royal Thai Government’s Ministry of Public Health policy of imposing compulsory licenses on patented medications. Developed and implemented enforcement of invention and process patents for several blockbuster drugs against manufacturers and distributors of infringing copy drug products.
  • Lead counsel for Diageo PLC, the global leader in whisky and spirits sales, and for Philip Morris International, a global leader in the manufacture and sale of cigarettes, in planning and execution of a defensive strategy to respond to the Royal Thai Government’s Ministry of Public Health policy of imposing a total advertising ban on all tobacco and spirits products. Developed and implemented brand protection and anti-counterfeiting programs in Thailand, Laos, and Cambodia.
  • Lead counsel for Philip Morris International in coordinating an international criminal inquiry of the leader of a British organized criminal syndicate known as the "Bandidos", operating from Pattaya, Thailand, arresting Mr. Robert Philip Johns on three occasions in Thailand and planning his eventual extradition to the US to face civil and criminal proceedings in the Southern District of New York.
  • In 2003-06, developed and managed a program for several leading multi-national pharmaceutical companies involving comprehensive anti-counterfeiting campaigns to enforce rights to blockbuster consumer drugs. The campaigns involve civil action, police raids, interface with the Thai FDA and media/public relations.
  • Established a specialised High-Tech Enforcement Team that has been in the forefront of representing software developers protect their copyrighted software code through vigorous enforcement actions against manufacturers, retailers and end-users of pirate unlicensed software. Between 2003-2006, secured more than US$4 Million in fines and settlements for copyright owners as a result of raids and prosecutions of retail and institutional end-user pirates, including a record US$450,000 settlement for one well-known software developer. The High-Tech team has also been a leader in raiding Thailand-based Internet distributors of infringing content and counterfeit goods.
